1. Agreement to Terms

By accessing or using ApplyOperator ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and ApplyOperator.

2. Description of Service

ApplyOperator provides a managed AI agent marketplace where pre-built agents are available via REST API and a web dashboard. Our agents perform cognitive tasks including data verification, company intelligence gathering, and research operations. Users send requests, agents process them, and structured results are returned.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including API keys. You must notify us immediately of any unauthorized use of your account.

  • You must be at least 18 years old to create an account.
  • You may not create multiple accounts for the purpose of abusing promotions or free credits.
  • You are responsible for all activity that occurs under your account.

4. Credits and Payment

ApplyOperator uses a prepaid credit system. Credits are purchased in advance and consumed when agents are run. Pricing varies by agent and complexity level.

  • New accounts receive $5.00 in free credits upon registration.
  • Credits are non-refundable except where required by law.
  • Credits do not expire.
  • Pricing is subject to change with 30 days' notice.
  • All payments are processed through Stripe. By purchasing credits, you also agree to Stripe's terms of service.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Infringe upon the rights of any third party.
  • Submit malicious, fraudulent, or misleading data.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to harass, stalk, or harm any individual.
  • Exceed published rate limits or abuse the API in a manner that degrades performance for other users.

6. API Keys and Security

API keys are provided for programmatic access to the Service. You are solely responsible for securing your API keys. Do not share, publish, or embed API keys in client-side code. If you believe an API key has been compromised, revoke it immediately through your dashboard.

7. Marketplace

The ApplyOperator Marketplace allows third-party developers to publish agents. While we review all marketplace submissions, we do not guarantee the accuracy, reliability, or safety of third-party agents. Use of marketplace agents is at your own risk.

8. Intellectual Property

The Service, including its design, code, logos, and documentation, is the property of ApplyOperator and is protected by intellectual property laws. You retain ownership of all data you submit to the Service. We claim no ownership over your input data or agent results.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Agent run results are stored for 90 days unless you delete them earlier. We may use aggregated, anonymized usage data to improve the Service.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service downtime.

11. Limitation of Liability

To the maximum extent permitted by law, ApplyOperator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that agent results will be accurate, complete, or error-free. You acknowledge that AI-generated outputs should be independently verified before use in critical decisions.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Any unused credits may be forfeited upon termination for cause.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
